1. Acceptance of Terms

3. Services

We provide performance marketing, Google Ads management, conversion optimisation, and virtual assistant services. Specific deliverables and timelines are defined in individual service agreements or proposals.

4. Accounts & Accuracy

You agree to provide accurate information and to update it as needed. You are responsible for maintaining the confidentiality of credentials for any client portals we provide.

5. Billing, Payments, and Refunds

• Fees are due as specified in your service agreement or invoice.
• Ad spend is billed directly by advertising platforms (e.g., Google) to your account unless otherwise agreed.
• Unless a statutory right of withdrawal applies (see section 6), fees are non-refundable once services have commenced, except where required by mandatory law.

6. Right of Withdrawal (EU Consumer Rights)

If you are a consumer within the EU, you have a 14-day right of withdrawal from the date of entering a service agreement, as provided by the EU Consumer Rights Directive (2011/83/EU) and the Danish Consumer Contracts Act (Forbrugeraftaleloven).

• To exercise this right, send a clear written statement to support@dk.scaleorbitmarketing.com within 14 days.
• If you have expressly requested that services begin during the withdrawal period and subsequently withdraw, you may be required to pay a proportionate amount for services already provided.
• This right does not apply to business-to-business (B2B) engagements.

7. Term, Cancellation, and Rescheduling

• Engagement terms are set in the service agreement. Either party may terminate as outlined therein.
• Unpaid fees through the effective termination date remain due.

8. Client Responsibilities

• Provide timely access to accounts, assets, and approvals.
• Ensure landing pages and websites comply with applicable laws and platform policies.

9. Advertising Policies

You agree to comply with Google Ads and other platform policies. We reserve the right to refuse campaigns that violate applicable policies or laws.

10. Intellectual Property

All materials on this website are owned by or licensed to us and protected by applicable intellectual property laws. Campaign assets created under a paid engagement may be licensed or assigned as specified in your service agreement.

11. Confidentiality

Each party will keep the other’s non-public information confidential and use it only for performing obligations under the engagement.

12. Third-Party Links and Tools

Our website may include links to third-party sites or tools. We are not responsible for third-party content or privacy practices.

13. Disclaimers

Marketing results depend on many factors and are not guaranteed. We will perform services with reasonable care and skill. To the extent permitted by applicable Danish and EU law, we disclaim further warranties, express or implied. Nothing in these terms limits rights that you have under mandatory consumer protection legislation that cannot be excluded by contract.

14. Limitation of Liability

To the fullest extent permitted by Danish law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits. Our aggregate liability will not exceed the fees you paid to us in the three months preceding the claim. This limitation does not apply where Danish or EU law prohibits such limitation (e.g., liability for wilful misconduct or personal injury).

15. Data Protection

We process personal data in accordance with our Privacy Policy and the GDPR.

16. Changes to Terms

We may update these Terms. The current version is always published on this page with its effective date. Continued use of the website constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Denmark. Any disputes shall be resolved by the courts of Copenhagen, Denmark. If you are a consumer, you also retain the right to bring proceedings in the courts of your habitual residence, as provided by EU Regulation 1215/2012.
